The National Highway Traffic Safety Administration (NHTSA) sponsored a study that concluded approximately twice as many car drivers would die in collisions with trucks than in similar collisions involving cars. Occupants of passenger cars and trucks have much higher fatality rates than in other accidents.

More and more tractor-trailer rigs, and large trucks, are on the roads today and driving at dangerously high speeds. This is putting other drivers at a very high risk of being in an accident. Trucks that haul hazardous materials, called “haz-mats,” can turn a fender-bender into a deadly scene. Speed is not the only thing that causes accidents. Drivers are being put behind the wheel of their trucks without proper experience and training. Others are fatigued, because they are pushed to drive more hours than allowed by law, in order to meet tight delivery schedules. Still other drivers are put into overloaded trucks or dangerous double- and triple-trailer rigs, or trucks with bad brakes. These and other factors have led to a sharp increase in accidents involving trucks.

Truck wrecks, caused by negligence, creates untold suffering in our country. The physical pain and injuries, property loss, costly repair or replacement of vehicles and loss of income can be overwhelming. Personal injury is defined as an injury not to property, but to a person. A Tort is an injury to one person for which the person who caused the injury is legally responsible. A tort can be intentional, but is far more likely to result from negligence. The injury that forms the basis of a tort is usually physical, but this is not a requirement. Libel and slander are also Torts, but they are not based on a physical injury.

Examples of truck negligence generally fall into two categories: driver error and vehicle maintenance failure.

Driver Error: The most common cause of driver error is fatigue, which can cause the driver to fall asleep at the wheel. Driver error can also be due to inexperience, improper driver training and driving under the influence of alcohol or drugs. Trucking companies who allow inexperienced or reckless drivers to operate large vehicles greatly increase the chances of a truck wreck. Trucking companies can be just as negligent as the driver’s themselves. Companies who ignore safety recommendations contribute to a large number of the accidents involving trucks.

Vehicle Maintenance Failure: The negligence of improper truck maintenance is most frequently found in the tires or brakes. Sadly, these issues, again, relate to the trucking company gambling with your life by trying to save themselves a few dollars. It is estimated to cost more than $100 per hour to have a truck out of service. This does not include the losses related to equipment utilization, the cost of the service call and the subsequent customer dissatisfaction.
